Policies

 

Photographic Release: Photographs of classes and students will be taken by TC Arts staff and representatives. Images may be used for marketing purposes including printed and social media, among others.  Student and Parent/Guardian grant and convey unto Transylvania Community Arts Council (TC Arts) all rights, title, and interest in and to any and all photographic images, and video and audio recordings made by or on behalf of TC Arts during the Student’s activities with TC Arts and the Arts Academy, including but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.

 

Cancellations/Withdrawals/Refunds: TC Arts reserves the right to cancel any class with insufficient enrollment and will refund 100% of your registration fee.  Notification of class cancellations will be made at least three (3) calendar days prior to the first day of class.

 

Any request for withdrawal or cancellation by Parent/Guardian must be made in person or over the phone at least ten (10) business days before the start of the class(es) to be eligible for a TC Arts voucher. Email and voicemail withdrawal WILL NOT BE ACCEPTED and any voucher that would otherwise be due will be forfeited. If notification of withdrawal is not received at least 10 business days prior to the start of the class, all fees paid for the class will be forfeited.

 

No monetary refunds will be given for a student’s voluntary withdrawal.  Instead, a TC Arts voucher, less a $50 processing fee, will be issued for future use.

 

WAIVER OF LIABILITY, MEDICAL RELEASE, & INDEMNIFICATION AGREEMENT: In consideration for Student being permitted by TC Arts to participate in the Arts Academy, Student and Parent/Guardian hereby waive, release, and discharge any and all claims and damages for personal injury, death, or property damage which Student and/or Parent/Guardian may sustain or which may occur as a result of Student’s participation in these activities. Student and Parent/Guardian understand, acknowledge and agree that: (1) This release is intended to discharge in advance the employees, officers, directors and agents of TC Arts from and against any and all liability connected in any way with the Student’s participation in activities at TC Arts; (2) Student and Parent/Guardian voluntarily request permission for Student to participate in activities at TC Arts; (3) Student and Parent/Guardian expressly and specifically assume any and all risks of injury, death, harm or property damage, and release and hold harmless TC Arts, its directors, officers, employees and agents from all liability for injury, illness, death, or property damage resulting from Student’s participation in activities at TC Arts;  (4) This waiver, release and assumption of risk is to be binding on the heirs and assigns of Student and Parent/Guardian; (5) Student and Parent/Guardian indemnify and hold TC Arts and its directors, officers, employees and agents harmless from any loss, liability, damage, cost or expense, including litigation, which TC Arts and/or its directors, officers, employees and agents may incur as a result of any injury and/or property damage which Student and/or Parent/ Guardian may sustain while participating in such activities; (6) Student and Parent/Guardian will make good any loss or damage or cost TC Arts and/or its directors, officers, employees and agents may have to pay if any litigation arises on account of any claim made by Student and/or Parent/Guardian and/or by anyone on Student’s and/or Parent/Guardian’s behalf; (7) In the event that Student requires medical or surgical treatment while under the supervision of TC Arts personnel in connection with the Arts Academy, supervising personnel may authorize treatment; (8) Student and Parent/Guardian will pay all medical, hospital, or other expenses which Student and Parent/Guardian may incur as a result of such treatment;(10) activities and participation in the Arts Academy are not childcare as defined by the State of North Carolina. Parent/Guardian certifies that Parent/Guardian has custody or is the legal guardian of Student by court order, and that Student is physically able to participate in the described activities. Student and Parent/Guardian have carefully read this Waiver of Liability, Medical Release, and Indemnification Agreement and fully understand its contents. Student and Parent/Guardian are aware that this is a release of liability and a contract between Student and Parent/Guardian and TC Arts, and that Student and Parent/Guardian sign it of their own free will.

 

Behavior Policy:  To ensure a quality experience for all involved, TC Arts reserves the right to refuse/remove a student due to behavioral problems.  If a situation arises and a student is asked to leave, class fees will be forfeited with no refund/voucher.

 

COVID-19 Safety:  The health and safety of our community is our main priority.  TC Arts adheres to all local and state mandates, follows CDC and NCHHS guidelines, and will adapt as necessary.

 

All staff, instructors, interns, volunteers, and students will participate in increased handwashing and use hand sanitizer. 

 

If staff, instructors, interns, volunteers, or students begin to experience illness or symptoms of COVID-19, they will be kindly asked to leave the facility or be picked up along with any siblings who are attending the program. TC Arts will communicate with families if a staff member, instructor, intern, volunteer or student within their child’s group is diagnosed with COVID-19.
